वन स्वराज आन्दोलन की सभा में आदिवासियों ने भरी वनाधिकार के लिए हुंकार
“छत्तीसगढ़ के आदिवासियों और वननिवासियों का हक़ छीना जाना अब बर्दाश्त नहीं किया जायेगा. हमारे बहुत संघर्ष के बाद जंगल जमीन पर हक़ पाया है, सरकार को हमारे अधिकार का सम्मान करना होगा. चुनाव के समय, आज की सरकार ने जो वादा किया था, उसे निभाने का वक्त अभी है.” उक्त बाते बुढा तालाब, रायपुर में वनाधिकार की मांग को लेकर आयोजित की गयी वन स्वराज सभा व रैली में कही गयी. छत्तीसगढ़ में वनाधिकार कानून के क्रियान्वयन पर सरकार को अपना वाद याद दिलाने और आदिवासियों पर हुए ऐतिहासिक अन्याय को ख़त्म कराने के लिए वन स्वराज आन्दोलन का आयोजन वन अधिकार और आदिवासी अधिकार पर लड़ने वाले प्रदेश के 30 से अधिक संगठनों ने किया था, जिसमें विभिन्न वनक्षेत्रों से करीब दो हज़ार लोग शामिल हुए थे.
वन स्वराज सभा में स्पष्ट किया गया कि देश की संसद द्वारा आदिवासी व वन-निवासी समुदायों के अधिकारों के लिए वनाधिकार कानून बनाया गया है, लेकिन, जंगल जमीन पर उनके अधिकार को मान्य नहीं किया जा रहा हैं. यह अधिकार कोई भीख या दया नहीं है, बल्कि वन निवासियों का संविधान सम्मत अधिकार है. वन अधिकार दिये जाने का छत्तीसगढ़ सरकार का चुनावी वादा और घोषित प्राथमिकता के बावजूद भी, इस महत्वपूर्ण कानून का क्रियान्वयन सही नहीं किया जा रहा है. केंद्र व प्रदेश के सरकार की कॉर्पोरेटपरस्त नीतियां, प्रशासनिक लापरवाही और राजनैतिक इच्छाशक्ति के अभाव की वजह से यह सब हो रहा है।
सभा को सम्बोधित करते हुये, आदिवासी महासभा के मनीष कुंजाम ने कहा कि आदिवासी बिना लडे अपनी अस्मिता को नहीं बचा सकते. बैलाडीला की 13 नम्बर डिपोसिट खदान को अडानी को सौंपने के लिये राज्य सरकार ने फर्जी ग्रामसभा की जांच रिपोर्ट को दबा कर बैठी है. आदिवासियो की अवाज़ को दबाने के लिये उल्टे नये पुलिस कैम्प खोले जा रहे हैं. जिस दिन आदिवासी जमीन से हट गये, उस दिन से उनकी परम्परा, नाच-गान, भाषा-बोली सब समाप्त हो जायेगा.
हाथी प्रभावित क्षेत्रों से आये ग्रामीणों ने बताया कि, हम लोग लगातार कई वर्षों से हाथियों के हमले झेल रहे हैं, लेकिन मुआवजे की राशि नहीं मिलती, या मुश्किल से मिलती है, तो वह भी काफी कम. अब सुनने में आ रहा है कि हमारे गाँव को हाथी रिजर्व में जोड़ा जा रहा है. हम नहीं चाहते कि हमारे घर-बाड़ी-खेत को अभ्यारण्य बनाया जाये, ऐसे कई उदहारण है कि अभ्यारण्य में तो वन अधिकार छीन लिया जाता है” छत्तीसगढ़ वनाधिकार मंच के गंगाराम पैकरा ने कहा कि हम हाथी रिजर्व क विरोध करते हए, क्योंकि, इससे कोयला खदानो के लिये गांव हटाने का रास्ता साफ हो जायेगा. विस्थापन का विरोध बेचारा हाथी तो नही कर पायेगा, पर आदिवासी जरुर करेगा.
वन स्वराज आंदोलन के सन्योजक बिजय भाइ ने कहा कि “आदिवासियों की पारंपरिक लोकतान्त्रिक स्वशासन व्यवस्था को अपनाते हुए, देश में पेसा और वनाधिकार जैसे कानून लागू है, जो जल- जंगल-जमीन पर सामुदायिक मालिकी और नियंत्रण को मान्य करता है, पर आज उसका खुल कर हनन किया जा रहा है. यदि, वनाधिकार कानून को ठीक से लागू किया जाता तो, आज छत्तीसगढ़ के आदिवासी बहुल वन-क्षेत्रों की प्रबंधकीय व्यवस्था लोकतान्त्रिक तौर पर ग्रामसभा के प्रभुत्व में स्थापित होती. यह एक मौका था, जब अंग्रेजों के ज़माने में जंगल को लूटने वाले कानून के बदले, जंगल के शासन का लोकतंत्रीकरण किया जाता. इस वर्ष गांधीजी की 150 जयंती पर स्वराज की बात करने वाले, जंगल में स्वराज स्थापित कर, उन्हें सच्ची श्रद्धांजलि दे सकते थे”
छत्तीसगढ़ वनाधिकार मंच, गरियाबंद की लोकेश्वरी नेताम ने बोली कि जंगल हमारी जिंदगी है. आदिवासी बगैर जल, जंगल, जमीन और जानवर के बिना नही रह सकता. हमारा सविधान भी हमे यह हक देता है. पर हमारे सम्विधान से छेडछाड हम बर्दाश्त नही करेंगे.
वनाधिकार संघर्ष समिति के सुरजु ठाकुर ने कहा कि देश के शासक वर्ग और पूंजीपतियों के दबाव के चलते, भारतीय वन कानून 1927 के जरिये और नयी भारतीय वन नीति लागू करने का प्रयास कर, वन स्वराज मिलने से पहले ही ख़त्म करने की कोशिश की जा रही है. यह आन्दोलन, देश के सर्वोच्च न्यायालय में वनाधिकार कानून की संवैधानिकता पर विचाराधीन मामले, और उससे उत्पन्न स्थिति पर चिंता व्यक्त करता है, जिससे लाखो आदिवासी परिवारों पर बेदखली की तलवार लटक रही है. सुनवाई के समय, खुद केंद्र व राज्य सरकार आदिवासी हितों के पक्ष में कमजोर दलील देकर या अनुपस्थित रह कर, वनाधिकार को कमजोर कर रही है. परिणामतः, कोर्ट के बेदखली का आदेश स्थगित तो है, पर बेदखली का खतरा टला नहीं है।
हसदेव अरन्य संघर्श समिति के उमेश्वर आर्मो ने बताया कि अडानी कम्पनी के लिये फर्जी तरीके से ग्रामसभा की सहमति ले कर वनभूमि छीनी गयी है, जिसके विरोध मे ग्रामीण पिछ्ले 36 दिनो से धरने मे बैठे है, पर सरकार उनकी सुध नहीं ले रही है, इस लिये उन्हे रायपुर तक आना पडा.
आदिवासी भारत महासभा के सौरा यादव ने कहा कि वन स्वराज आन्दोलन, वन एवं पर्यावरण मंत्री के उस बयान का स्वागत करता है, जिसमें उन्होंने भारतीय वन अधिनियम 1927 में प्रस्तावित संशोधनों को वापिस लेने की बात की है. यह देश भर के उन जन संगठनों और आन्दोलनों की जीत है, जो लगातार इस संशोधनों का विरोध करता रहा है. वन स्वराज आन्दोलन, इस सभा के माध्यम से चेतावनी देना चाहता है की भविष्य में यदि औपनिवेशिक और दमनकारी प्रवृत्ति के भारतीय वन अधिनियम 1927 में संशोधन करने की कोशिश की गयी तो उसका देश भर में पुरजोर विरोध किया जायेगा. वनाधिकार कानून लागू होने के बाद, 1927 के कानून का वन स्वराज के लिए कोई औचित्य नहीं रह जाता.
सभा को पूर्व केंद्रिय मंत्री श्री अरविंद नेताम, पूर्व सांसद श्री सोहन पोटाई, पूर्व विधायक, श्री झनकलाल ठाकुर, मनीष कुंजाम, पूर्व आइ.ए.एस. श्री बी.पी.एस. नेताम ने भी सम्बोधीत किया.
सभा मे वन स्वराज लागू करने के लिये हमारी प्रमुख मांगे है कि- :
* वन अधिकार कानून के क्रियान्वयन को प्रदेश सरकार प्राथमिकता पर मिशन मोड में लाये.
* गलत तरीके से ख़ारिज किये या बगैर सुनवाई का अवसर दिए ख़ारिज किये गए दावों पर पुनर्विचार कर वाजिब दावे मान्य किये जाये. प्रत्येक निरस्त दावों के कारणों को दर्ज कर दावेदार सहित सार्वजानिक जानकारी में उपलब्ध रखा जाये.
*खनन, उद्योगों एवं विकास परियोजनाओं के लिए वनभूमि के व्यपवर्तन(डायवर्सन) के लिए ग्राम सभा की दबाव-मुक्त, लिखित अनिवार्य सहमति लेने का पालन किया जाये.
* भारतीय वन अधिनियम, 1927 में प्रस्तावित संशोधनों को भविष्य में लागू न होने दिया जाये, और वन अधिकार कानून की मंशा के अनुरूप राज्य कानून में बदलाव किया जाए ।
* प्रदेश में शून्य विस्थापन की नीति अपनाई जाये. विशेष रूप से वनजीव अभ्यारण्यों, टाइगर रिजर्व एवं राष्ट्रीय उद्यानों तथा विशेषरूप से कमजोर आदिवासी समूहों की बेदखली को तुरंत रोका जावें।
* हाथी रिजर्व सहित, प्रदेश में कोई भी वनजीव अभ्यारण्य घोषित करने से पूर्व सम्बंधित ग्राम सभाओं की दबाव मुक्त, पूर्व-सूचित सहमति ली जाये.
* वन विभाग द्वारा व्यय किये जाने वाले क्षतिपूर्ति वनीकरण निधि (कैम्पा) सहित अन्य मदों पर ग्रामसभा का नियंत्रण, वनाधिकार नियम 4(1)च के तहत सुनिश्चित किया जाये.
* राज्य सरकार वनाधिकार कानून के सभी उल्लंघन के प्रति अति संवेदनशीलता रहे एवं वनाधिकार के विरुद्ध दायर याचिकाओं की सुनवाई के दौरान उच्चतम न्यायालय व उच्च नयायालय में सजगता से जनपक्षीय दलील रखें |
